The Geneva Convention has a fairly detailed definition of what constitutes a mercenary.

As the French Foreign Legion is a recognised part of the French Army, its Legionaires are
not defined as mercenaries under the Geneva Convention. It's the same for Gurkhas serving in either the British and or Indian Armies.
